1. General
These Terms and Conditions apply to all services provided by Code Mountain B.V., registered in the Netherlands under KvK number 95114955, with registered address at Jan Steenstraat 13, 4715 BP Rucphen, Netherlands. By placing an order or using our services, you agree to these terms.
2. Services
Code Mountain B.V. provides online digital services including, but not limited to: custom website development, web application development, e-commerce solutions, API development, SEO optimization, website redesign, website maintenance, and landing page design. All services are delivered digitally. No physical products are delivered.
3. Orders and Agreements
An order is placed when a client submits the order form on our website. After receiving an order, Code Mountain B.V. will contact the client via email to confirm the project details, scope, timeline, and payment arrangements. A binding agreement is formed only after written confirmation by Code Mountain B.V.
4. Pricing and Payment
All prices listed on the website are starting prices in Euros (EUR). Final pricing may vary depending on project scope and requirements, as agreed upon in writing. Payment terms will be communicated upon order confirmation. Code Mountain B.V. reserves the right to request a deposit before commencing work.
5. Delivery
All services are delivered digitally. Delivery timelines will be agreed upon in writing after order confirmation. Code Mountain B.V. will make reasonable efforts to meet agreed timelines, but cannot be held liable for delays caused by circumstances beyond its control.
6. Intellectual Property
Upon full payment, the client receives ownership of the final deliverables. Code Mountain B.V. retains the right to display completed work in its portfolio unless otherwise agreed in writing. Third-party components, libraries, and frameworks used in projects remain subject to their respective licenses.
7. Revisions
The number of revision rounds included in each service is specified in the service description. Additional revisions beyond the included rounds may be charged at an hourly rate, to be agreed upon in writing.
8. Cancellation
Orders may be cancelled before work has commenced without charge. Once work has begun, cancellation may result in charges for work already completed. Cancellation requests must be submitted in writing to [email protected].
9. Liability
Code Mountain B.V. is not liable for any indirect, incidental, or consequential damages arising from the use of our services. Our total liability is limited to the amount paid for the specific service in question.
10. Governing Law
These Terms and Conditions are governed by Dutch law. Any disputes will be submitted to the competent court in the Netherlands.
